Self-Help Prohibited

In the past, the common law "self help" repossession remedy often led to violence between landlords and residential tenants. This system has been replaced with statutes, which provide that real property tenants are not "trespassers" even if they fail to pay rent or have breached the terms of their tenancy. Tenants are entitled to peaceful possession until a proper legal process, by settlement or judgment, awards possession to the landlord.

Lease Termination Notices

Your eviction case can rise or fall based upon the lease termination notice. Any defect in the notice or the manner of service can lead to a landlord losing an eviction case. It is critically important to have an attorney prepare or review any lease termination notices prior to service.

Important Timelines for Notices and Legal Action

In order for a landlord to terminate a tenancy for cause, service of one or more of the following legal notices is normally required:

  • Three Day Notice to Pay Rent or Quit
  • Three Day Notice to Perform Covenant or Quit
  • Three Day Notice to Quit

Generally, in order to terminate a month-to-month tenancy without cause, the landlord may serve a written notice of termination of tenancy at any time. The notice must give the tenant at least 30 days' prior notice to vacate unless the tenant has lived at the premises for a year or more, in which case the notice must give the tenant at least 60 days' prior notice to vacate.  Certain restrictions apply.
